1. Parties and scope
These terms govern the relationship between Wolob (the company is being incorporated; its legal name and address will be published on this page once incorporation is complete) ("Wolob", "we") and the publisher or organisation using the Wolob service ("Customer", "you"). By using the service, or by accepting an order, quote or contract, you accept these terms. Where you have a separate written contract with us, it prevails on any conflicting point.
2. The service
Wolob is a cloud news CMS: setting up news sites, an editorial dashboard, themes, agency and RSS feeds, hosting, a content delivery network and related modules. The scope of the service follows your plan and what is written in your order or quote. We keep improving the service, may add features and may change features that are no longer used after reasonable notice.
To connect your domain you add the DNS records shown in your panel at your DNS provider; registering and renewing the domain remains your responsibility.
3. Account and security
You are responsible for keeping account details accurate, for your users' permissions and for keeping passwords confidential. Tell us immediately at hello@wolob.com if you notice unauthorised use. We recommend two-factor authentication for administrator accounts.
4. Fees and billing
- The service has a one-time setup fee and a monthly fee. Current prices are on the pricing page or in your quote; prices exclude taxes.
- The monthly fee follows your plan's monthly pageview limit. Pageviews are counted by our own server and content-delivery measurement; numbers from third-party tools such as Google Analytics are for comparison only.
- If you go over your limit, your site stays up; the overage fee on the pricing page is added to that month's invoice for each extra 100,000 pageviews.
- Payment method, billing period and due dates are set out in your order or contract. If invoices remain unpaid, we may, after notice, switch the service to read-only mode or suspend it.
5. Content and responsibility
You are the publisher of all stories, images, comments and other content on your site, and you are responsible for its compliance with press, copyright, personality-rights and data protection laws. You are the controller of your readers' personal data; Wolob processes it on your behalf.
As the hosting provider of your site, Wolob does not review content in advance. When we receive an order from a competent authority or a valid notice about unlawful content, we inform you and take the steps the law requires.
6. Acceptable use
You may not use the service to:
- publish unlawful content, hate speech, content glorifying violence or crime, or content related to the abuse of children;
- send unsolicited email (spam). Newsletters and notifications sent through the service may only go to recipients who explicitly subscribed and confirmed their subscription, and every message must contain an unsubscribe link. Purchased or scraped address lists are not allowed;
- spread malware, run phishing, attack other systems or the service itself, or try to bypass security measures;
- put load on the service that affects other customers.
If these rules are broken we may stop the content or sending concerned and, if it happens again, suspend the account.
7. Availability and maintenance
We aim to keep the service available without interruption (a monthly availability target of 99.9%). Planned maintenance and incidents are posted on our status page. A binding service level agreement (SLA) is only given in a separate written contract.
8. Data, export and termination
Your content belongs to you, and you can export it from the dashboard during the contract. You may end the contract at any time, effective at the end of the billing period. After the end, your data is kept for a reasonable period so you can export it and is then deleted, subject to statutory retention duties.
9. Intellectual property
The Wolob software, themes, brand and documentation belong to Wolob. During the contract you receive a non-transferable, non-exclusive right to use the service.
10. Limitation of liability
To the extent permitted by law, Wolob is not liable for indirect damages, loss of profit or data, or third-party claims. Our total liability is limited to the amount you paid for the service in the 12 months before the event giving rise to the claim. Liability for intent, gross negligence and liability that cannot be limited by law remains unaffected.
11. Changes, governing law and contact
We may change these terms and will email you about significant changes at least 30 days before they take effect. The governing law and place of jurisdiction will be added to these terms once the company's incorporation is complete. Questions: hello@wolob.com.
